The essentials

What matters for a K-1 visa?

01

US citizens only

Only a US citizen can petition for a fiancé(e). Green card holders cannot use the K-1 route.

02

You must have met

In general you must have met in person within the two years before filing. Narrow exceptions exist.

03

Marry within 90 days

After entry you must marry the petitioner within 90 days. The K-1 cannot be extended or changed into another status.

04

Then the green card

After the wedding your spouse applies for a green card through adjustment of status.

Easy to start

No big leap.
Just a first step.

You tell us what is going on. We find the right attorney for it.

  1. 01

A few words about your situation.

Choose your topic and leave your contact details. You don’t need a complete file to get started.

  2. 02

    A free first call.

Our intake team gets in touch, clarifies what you need and connects you with an independent attorney licensed in California.

  3. 03

A flat fee before any work.

The attorney reviews your case and quotes the scope and a fee in writing. You decide whether to go ahead.

For later, not for now

What you can have
ready for the call.

You don’t need to upload anything in the form. These documents can help later:

  • Proof of your US citizenship
  • Evidence that you met in person and of your relationship
  • Evidence of your intent to marry, such as wedding plans

Marrying abroad before the K-1 is issued changes the process. Talk to an attorney first. An enquiry does not stop any deadline.

You may still be wondering …

Before we
talk.

K-1 or marry first?

It depends on where you want to marry, how fast your fiancé(e) needs to work and on current processing times. Your attorney compares both routes with you.

Can my fiancé(e) work on a K-1?

Only after applying for and receiving work authorization. Many couples file it together with the green card application after the wedding.

What does the first call cost?

The first call is free and without obligation. If you want an attorney to take on your matter, the attorney quotes the scope and fee in writing before any work starts.

What happens after I send my request?

Our intake team reviews your request and gets in touch to clarify it and arrange the call. Sending the form does not create an attorney-client relationship and does not book an appointment.
